I asked some related questions a year or two ago to “authorities” on the topic and they were wrong – Even tho I expected them not to be..

1) 1.5+ years ago I received an out of state DUI in another I.D.L.C. member state. My home state and the other state are both full members. This would have made my second DUI total in 11 years so I was concerned. The charge was reduced to reckless driving, I was issued a temporary lic. # in that state, and then I had to carry out terms of probation/fines from my own state and fax/mail all the stuff to the offending state. Did all that, probabtion was terminated, and it never appeared on my home state record. So .. apparently the IDLC has its loopholes? It never even appeared as reckless driving, and this is almost 2 years ago. I have checked my record, been pulled over, and renewed my plates and even my license during that time. Nothing came of it. Either from the secretary of state, or my insurance company. Even tho I reasoned that I was going to get out of 2 DUIs due to the reduction in charges, (the local cop out of state said I had nothing to worry about) every other person on sites just like Yahoo Answers insisted I would be “paying for this” in my home state.. So my questionis, how could this have happened? Blind luck?

2) Separately, I hadnt gotten any speeding tickets in 9 years, then 2 years ago , I got three speeding tickets in the same year, was suspended briefly (ironically the IDLC did work here because these were all out of state speeding tickets just like my dui/reckless), but my INSURANCE never caught it. And when I say never caught it .. my insurance expired and so I renewed it, I also made significant policy changes after the tickets and suspension, I moved and notified them after that, and added renters then homeowners to my policy, I even changed vehicles twice! Basically giving them every opportunity to catch it, but they didnt catch any of it .. the tickets, suspension (or dui/reckless from the point above). Is this common?

Im sure I will get plenty of “you should burn” replies, but Im more amazed at the (lack of) processes that companies and govt. have in regard to this. I’m truly wondering if ppl getting lucky like this are more common than most ppl believe – or if this is just blind good luck.
Anyone with feedback or similar experience I would love to hear from as well as any law enforcement, insurance agent, or attorney who would like to weigh in. Im really not being smug about it, but I find this pretty incredible.

To the second poster.. yeah… thats what Im thinking too? Alot has changed in law enforcement/exchange of info/ and penalties in the last 15 years, and probably in 5 or 10 more this type of thing wont get by them. But yeah.. it looks like a broke system to me at this point. Perhaps my reduction in charges fouled up the normal procedure or something..

What you are forgetting is that the average police officer usually does not know the back ends of what you are talking about – nor should he/she care.

Your DUI reduced to a reckless driving will show up on your criminal history – not ran by the DMV/SOS when you apply for a new license and it will also show up on your drivers abstract as a DUI charges and convicted of reckless driving.

The issue of whether your a first time offender – repeat offender in my state goes back to ten years – it is not erased, but they do not count it in the summary of suspension/implied consent when you are given the opportunity to take a breath test. So for it to count as a second DUI – for suspension purposes – it goes back ten years – but for sentencing – it’s there forever. Also you were not convicted of DUI – you were convicted of reckless driving – you have no convictions for DUI.

Reckless driving in my state – if convicted is a discretionary suspension and will only draw a suspension if your driving record is poor – a sole charge and conviction for reckless driving does not guarantee a suspension in my state.

The average police officer on a traffic stop, only sees your conviction record – for the last year – in order to see your record – conviction or charge – a drivers abstract needs to be ran through the SOS/DMV office.

Your insurance company – does not do minute by minute checks on your record – it cost money to run drivers abstracts – they are not free. Ask them why they did not – not the police. Updating license plates does not draw a license inquiry in my state – you can buy them at a car dealer, currency exchange or bank – none have access to SOS/DMV data.

You were caught on the moving violations, because you were convicted and enough cause was there to suspend you.

By the way – the non-resident violator compact you talk of – is for bonding out of state drivers on traffic charges – it has nothing to do with reporting – every state does that reguardless of whether or not it is a memeber.

There is a way that it is supposed to work. And then there is the way it actually does work. This is a big country, with a lot of people, and a lot of offenses. Sometimes they show up across states on your record, and other times they don’t. If you ask how it should work, people will tell you how it SHOULD work. If it doesn’t work that way, it’s not because they were wrong, but that you got lucky.

Even though technology is getting better, and there is more sharing of information, and there are bigger and better databases, there is still a very good chance of your data falling through the cracks. I wouldn’t want to bet my life on it, but I would be willing to wager a few bucks on any given incident.

Hell, I keep hearing about how car insurance companies routinely share information so drivers can’t scam them, yet I just switched comopanies, told the new one about the old one, and the old one still kept sending me pending cancellation notices since they hadn’t received payment. Big Brother is not as big as he’d have you believe, and he makes mistakes more often than not.
