Question: Can I Sue Experian?
I have applied for a credit card with bank of america several times and i have been denied i checked my credit history and im seeing wrong information which led to the denial of my credit card applications. Can i sue for damages? and experian does not even have a fax or telephone number where i can call to dispute the information on my credit report. They listed my birthday as 1985 instead of 1988 which caused collection agency debts that i owed when i was 17 to be posted on my account because they listed my birthday 1985 it showed that i was 20 when the debts came in but i was actually 17.

1. Do you have a fax or phone number where i can reach experian? (I get an error messege with the online dispute form)
2. Can i sue for damages since they caused me to be denied for a credit card over 2 times


You should get your annual free credit report BEFORE you make applications . . . and you can have the corrections done once you have that copy for reference.
and you can sue anyone you want in America, the big question is ‘ Is the cost of the legal action worth the return ?

Yes, you can sue Experian. I suggest small claims court. You will have to PROVE that they knowingly falsely reported negative information, and you will to prove that you have been damaged. Any lawyer would tell you that.

You need to dispute by mail. send them a letter telling them you feel you were denied credit due to an error on their part. Explain the problem (your birthdate), and list accounts that are on your report that shouldn’t be. Send a copy of drivers license, or state ID, and I’d also send a copy of my birth certificate. Make sure you tell them you’d like them to investigate, correct their errors, and send the new info to creditors that have obtained your credit report in the last 6 months. Send it certified, no signature required. Since, it’s going to a PO Box no one can sign for it, but you’ll know exactly what day they got it. Keep this certification from the post office, when you get their responce back if they haven’t changed anything then you can sue.
You’ve explained the problem, you’ve given proof, if they dont change it they’re wrong. Small claims will do just fine.


Yes, you can sue. But first you have to understand the law, and know how the game is played.

It’s going to be hard to sue Experian. Their job is only to report what is given the them by creditors. They DO NOT investigate their accuracy.

The only way Experian will be liable is if you dispute the entry, and they fail to “verify” the debt. But since all that is required of them is to call the creditor and ask if it’s legitimate and accurate, and if the creditor says it is, then the item stays. Again, no real investigation is done, but now Experian is off the hook.

What you need to do is send a certified letter/return receipt to the creditor and demand that he “validate” the date. That means he must PROVE that you owe this debt, and supply you with written contracts, bills, receipts, and everything that was used to calculate what they claim you owe.

If they do not supply you with this information, then you send another dispute letter to the credit bureau telling them that the creditor failed to “validate” the debt. Since it is illegal for the credit bureau to list “unvalidated” information to your credit report, THAT would be a violation and then you could sue Experian. But since they are getting much better at verifying debts, this isn’t likely to happen.

If, after you have sent these letters and the debt is not removed, you can sue both the creditor and the credit bureau. This is a small claims court suit and you do not need a lawyer to do it.

As for the part about posting debts while you a minor, it’s legal for them to do. If the debt was yours (even as a minor) they can list it. So don’t waste your time disputing those entries.

Now in the situation where a listing is posted to your report without validation, you can sue them for 00 for each occurance. You can also sue for damages that the listing caused, but the burdon of proof is on you to show how you were damages.

Simply being denied a credit card does not result in damages, unless you were forced to get another card with much greater interest rates.

The damage claims work better in cases where you were force to get a mortgage and the interest rate was much higher….or maybe you were denied employment due to a poor credit report. That’s much easier to prove for damages and you have a better chance to win.

I just saw a special on Dateline ID about this very scam. Evidently, you will get stung for the shipping fees and never get paid.


Scam. Notice the misspellings and poor grammar throughout. It tells you to drop off donations at UPS, but it doesn’t mention how the shipping will be paid for. Also, the only way to contact these people is via Yahoo! Messenger. A legit company would have an 800 number or at least a local number so you could talk to an actual person.

It’s scam.They compose a text and send it to people under different titles.Yahoo,gmail,…


I received this same email about a month ago. I didn’t follow up on any of it because this kind of crap filters through regardless of spam blockers.
Yahoo has been made aware and this is a totally bogus email.
Trash it as you would any other junk that comes through your mailbox.
I have also been receiving many emails from Nigeria. Do people truly fall for this crap? Do people really send complete strangers their personal information and send them thousands of dollars because they feel sorry for them?


This is the longest running scam on the internet today. Yahoo does not have lotteries. Yahoo does not give away money. You don’t win anything but the booby prize for opening spam, so now you will get more. Does this actually have your name on it, or is your name “Esteemed Winner?” Put this, and all the others to come, in spam and don’t open any more.

There are plenty of real payday loans online, but you would be a fool to use one. You would be giving them a pipeline to your bank account to take money out of it every payday. Not smart.

If you are that hard up for a payday loan, go to a lender who actually has a store and you can talk to a human. Sounds like you want to avoid that though, if you don’t even want to fax paycheck stubs etc.

sounds like a scam im pretty shure it is.. any advice on what i should do?


First of all, this is clearly a scam. You shouldn’t even had replied in the first place, as they now know probably have stored information about your email address. Don’t reply to any more emails, and probably notify send Toyota an e-mail explaining to them that someone are misusing their company name for fraud.

Secondly: Do you even own a Toyota? Have you participated in any contests? Do you really think anyone would just take 2,500,000 random email addresses and give money and cars to some of them?

Rule no. 1 of the internet: Use Common Sense!

Also, if you are in doubt, contact your nearest Toyota dealer and simply ask them.

They said dear sir/madam. If it was meant for you, they would’ve used your real name. If you don’t remember entering a toyota lottery, then you couldn’t have actually won one. After you replied, they said “Dear Winner” again, and not used your real name. If you won a lottery they’d probably have more than half that information they’re asking for already.


It is a scam. one of the easiest way to check is to look up the name of the organization. If they where legit they would have a site. Also they would not appear on plenty of scam sites as scam emails.

You may visit sites across the web but how many do you sign up to and leave your email address with.

If you did not enter it then there is no way you could win it.

One final check is to open the headers on the email which show the return email along with the ip address which is another way to check where the email originated from. They rarely match the country the supposed draw is taken place.

Also if you enter the phone numbers given they will show where they come form. The check them against the real number.. From the OFFICIAL site.

The numbers given are in china. But Toyota is a Japanese company.

All signs are pointing to scam..

Plus loads of scam email sites are reporting it as a scam

What you should do is leave it..

What i do when I get these types of emails is send an email back with all the links to the scam email sites with copies of their email.

If they where genuine they would get back but they never do…

Question: Allstate fraudulently billed me long after I asked for my policy to be canceled. What should I do?
14 days ago from this date, I called my local allstate insurance agency and asked them to cancel my policy right away. They told me with assurance and on the spot that I was no longer insured with them. Then 3 days after I found out my policy was still active online, I called them again and they said they will put a cancellation request. I called them four more times and they gave me the exact same response and days have passed, and my policy was still not canceled. Yesterday I found out they have debited $ 105 from my bank account. And up to today, my policy with them is still active and is showing my next billing date to Sept. 10.

So yesterday, I was arguing with these corrupt Allstate people on the phone, asking why they charged me when I ordered a policy cancellation two weeks ago. This time, they told me to fax them my new policy with Geico before they will effectively cancel my policy and issue me a refund. I’m just so infuriated with them right now. I have a feeling they will continue to play games with me. I faxed them my Geico declaration page yesterday morning, yet my policy with Allsate is still active to this hour. What are my options now?


The normal thing to do is cancel in writing and keep a copy of the correspondence.
I would never cancel anything on the phone


Continue to hound them until it’s done. Keep the documentation.

I’ve had to fight some battles. Don’t give up. Don’t be angry. Just be firm and polite. Ask to speak to a manager.


Provide your agent with a copy of your Geico policy showing the effective date. Ask them in writing to cancel your Allstate policy back to the inception date of the Geico policy and your money should be refunded to you. Allstate will not typically process a cancellation with out a signed request from the insured, that is probably why it did not cancel properly.
